Unions may apply to the regulator (Chief Executive, WorkSafe Tasmania) to have one or more of their officials granted a WHS entry permit. This permit allows union entry into workplaces for specified purposes.
Our guidance note Workplace Right of Entry by Work Health and Safety Entry Permit Holders (PDF, 195.2 KB) gives details of:
- the role of a WHS entry permit holder
- when they may enter a workplace and the notice they must supply
- what they may do after entry
- how disputes about right of entry are managed.
How to apply for a WHS entry permit
To apply for a WHS entry permit, you must be:
- an official of the union
- have satisfactorily completed approved training; contact WorkSafe for current details of the training provider
- hold or will hold a Fair Work entry permit, or are entitled to enter workplace under Section 77 of the Industrial Relations Act 1984.
If you meet all the above criteria, then you must:
- submit the completed WHS entry permit application (PDF, 959.9 KB) to WorkSafe Tasmania
- provide a current photograph
- provide a copy of your training certificate.
If the regulator is satisfied you meet the criteria and objective of the Work Health and Safety Act, you will be issued a permit.
Permits are valid for 3 years and your name will be listed on our website.
